According to NSA surveillance, the communication of US citizens is routinely captured when speaking with a foreign national. Even with this evidence, the Deep State denies that US citizens are actively under surveillance. In a 2013 open session of the Senate Intelligence Committee, James Clapper (National Intelligence Director) was asked if there was data being collected on US citizens. He claimed that “There are cases where they [intelligence officials] could inadvertently, perhaps, collect, but not wittingly.
THE CLAPPER “LIE,” AND THE SENATE INTELLIGENCE COMMITTEE
Director of National Intelligence James R. Clapper has been widely criticized for making a false statement at a March 2013 hearing of the Senate Intelligence Committee. What has gone unremarked, however, is the fact that the Committee permitted that statement to stand uncorrected.
Sen. Ron Wyden asked DNI James Clapper at a March 12, 2013 hearing “Does the NSA collect any type of data at all on millions or hundreds of millions of Americans?”
DNI Clapper replied “No, sir.” He added “Not wittingly. There are cases where they could, inadvertently perhaps, collect — but not wittingly.”
Based on this exchange, and in light of the revelations to the contrary made by Edward Snowden, some have concluded that DNI Clapper “lied to Congress,” as the New York Times editorial board put it last week. Some go further to suggest that the DNI should be prosecuted and imprisoned, as Sen. Rand Paul did yesterday.
It is of course wrong for officials to make false statements, as DNI Clapper did when he denied that NSA collects “any type of data at all” on ordinary Americans. But did the DNI actually “lie to Congress”?
In ordinary usage, lying usually connotes an intent to deceive. In this case, DNI Clapper could not have intended to deceive the Senate Intelligence Committee because the true answer to Senator Wyden’s question was already known to Senator Wyden and to all the other members of the Committee, as noted by ODNI General Counsel Robert S. Litt. Committee members could not have been misled by the DNI’s response, and it makes no sense to say that he intended to mislead them.
What remains true is that others — especially attentive members of the public — were deceived by the DNI’s statement. If DNI Clapper “lied,” it was to them, not to the Senate Intelligence Committee, that he did so. But the Committee permitted that deception to occur, and to persist, and so it must take its share of responsibility for that. Yet unlike the DNI (who apologized, several months after the fact, saying he misunderstood the question), the Committee has not acknowledged any failure on its part.
When Senator Wyden posed his question in open session, he was evidently attempting to corner the DNI and to compel him to involuntarily reveal classified information about the NSA bulk collection program. At the time, it seemed to be a clever rhetorical maneuver. Even if the DNI refused to respond or requested to answer the question in closed session, that would have indicated that something pertinent was being concealed.
However, by answering falsely, the DNI turned the tables on Senator Wyden and the Senate Intelligence Committee. Whether by design or not (almost certainly not), the DNI’s response challenged the Committee to make its own choice either to disclose classified information about the NSA program — in order to rebut and correct the DNI’s answer — or else to acquiesce in the dissemination of false information to the public.
(There was another conceivable option. Without revealing specific classified information, the Committee could have issued a statement that the record of the March 12 hearing included certain erroneous and misleading statements, and that it should not be relied upon.)
As it turned out, the Senate Intelligence Committee made exactly the same choice that DNI Clapper is accused of making. The Committee evidently decided that national security classification trumped any obligation it had to produce an honest and accurate public record. As a result, the Committee itself became complicit in an act of public deception.
This is deeply unfortunate. It means that unclassified Committee statements and publications cannot be granted an unqualified presumption of accuracy or good faith. With the Clapper gambit, the Senate Intelligence Committee moved beyond the familiar practice of secrecy and into the propagation of false and misleading information.
In 2011, Fusion GPS was hired by Democrats to do oppositional research on Mitt Romney, the then-presidential candidate for the GOP. In 2015, Fusion GPS was on a retainer with Planned Parenthood to investigate undercover videos (courtesy of the Center for Medical Progress) that allegedly pictured PP officials negotiating with medical researchers over the sale of fetal tissue taken from abortions. The grand jury did not indict PP officials, the producers of the videos (David Daleiden and Sandra Merritt) were charged with criminal felonies for invading privacy and filming without being given permission.
In May of 2016, Senator Ted Cruz dropped out of the race and Trump secured the GOP primary. With enough delegates to win the GOP nomination, Fusion GPS lost their funding, and Singer became a significant donor and supporter of the Trump presidential campaign. In April of 2016, Fusion GPS was retained to gather information on Trump by Hillary Clinton’s campaign and the DNC through Marc Elias, the lawyer of record for both entities. In November of 2017, Reuters reported that Elias’ firm, Perkins Coie, had paid over a million dollars to Fusion GPS. This money then went to Orbis Business Intelligence. Orbis then hired Christopher Steele, a member of British M16 intelligence with ties to US intelligence. Steele completed the dossier on Trump (called the “Russia dossier”) to counterintelligence officers in the FBI and, allegedly, to intelligence officers in England.
Although Fusion GPS attempted to get the “Russia dossier” published throughout the summer of 2016, their efforts ultimately failed because the information could not be verified. The first to publish the dossier was Mother Jones, in an article titled “A Veteran Spy Has Given the FBI Information Alleging a Russian Operation to Cultivate Donald Trump.” The article was published in October of 2016, just before the November election. Steele was paid by the FBI to continue gathering intelligence on the link between Trump and Russia. This payment was canceled once it was discovered that information within the “Russia dossier” had been falsified. As a result, Fusion GPS attracted congressional inquiries and media attention, and President Trump declared the dossier to be “fake news.”
In late October of 2016, James Comey (then FBI director) received a letter from Senate Minority Leader Harry Reid, urging him to make the “Russia dossier” public information. According to Senator John McCain, his first knowledge of the dossier was one month later, in November of 2016. McCain first stated that an emissary was given the dossier in an undisclosed airport. Since then, it has been suggested that McCain was personally handed a copy of the dossier by Fusion GPS with the agreement that he would assist in press distribution.
The official story told by McCain details a private meeting with James Comey in December of 2016. Roughly a week before Trump was inaugurated, BuzzFeed published an unredacted version of the dossier, titled “These Reports Allege Trump Has Deep Ties to Russia.” This contained allegations that Trump had been directly supported and groomed by Russia for years prior to his election.
